I. BACKGROUND
Plaintiffs in this Fair Labor Standards Act (FLSA) suit are fourteen Mexican farm workers who were legally employed in the United States between 2000 and 2005 on defendant Shannon Produce Farm, Ine.’s Georgia farm (the Shannon farm). Doc. # 1 at 3, 13. They have brought this claim under 29 U.S.C. § 215(a)(3) alleging that defendants (collectively Shannon Produce) refused to rehire them in retaliation for a 2005 FLSA lawsuit against Shannon Produce Farm to which the plaintiffs in this case were parties.
