WILLIAMS, PRESIDENT:
This is an action of assumpsit against John Newell, and five others. The declaration describes them as, “Trustees, of the First Presbyterian Church of Chester, W. Va.,” and contains the common counts only. Defendants pleaded non-assumpsit and set-off,.to which pleas plaintiff replied generally. On the issues thus joined a jury, on the 3rd of July, 1907, found in favor of the plaintiff the sum of $200.
