METZNER, District Judge.
Plaintiffs and defendant move for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure, 28 U.S.C.A. The complaint consists of four claims. The first claim alleges an infringement of the registered certification of the word “Roquefort” on cheese. Lanham Trade-Mark Act, § 4 (15 U.S.C.A. § 1054).
