Appeal from District Court, Rockwall County; P. L. Hawkins, Judge. Action by R. A. Deweese for himself, and as next friend of Ms two children, against the Southwestern Telegraph & Telephone Company and others. Prom a judgment of dismissal, plaintiffs appeal.

This suit was brought by R. A. Deweese, for himself and as next friend of his two children, Ruth and Wallace Deweese, against the Southwestern Telegraph & Telephone Company and its agents, J. N. Browning and W. P. Latimer, to recover damages which resulted to them from the death of Mrs. Deweese, wife and mother, respectively. J. N. Browning was alleged to be a minor, but that he holds himself out as of age and does business for himself. In the event it was shown he was not liable on account of nonage, his father, J. K.
