This suit was brought by appellant, as the surviving widow of J. M. Hendrix, for the benefit of herself and their minor children, against James L. Walton, as sheriff of Eavarro county, and the other appellees as sureties on his official bond. The petition alleged the official character of the defendant, Walton, and the execution of his official bond by himself and the other defendants as his sureties, and the" appointment by him of one W.
