Plaintiffs, A1 Tierney, Cathy Tierney, Bernard J. Sarley, Jan Sarley and Carrol E. Siebold, brought this action for injunctive and declaratory relief to prevent the defendant, Village, of Schaumburg (the Village), from constructing a 50-foot-wide collector or secondary street, without sidewalks on either side, adjacent to their homes. Plaintiffs alleged that the construction of the collector or secondary-street would violate the Village’s own ordinance. The trial court denied plaintiffs’ request for a temporary restraining order to preserve the status quo. Plaintiffs appeal. We reverse and…
