MEMORANDUM AND ORDER

MILLER, District Judge.

This cause is before the court on the defendant’s motion for summary judgment on the former Sharon Smith’s two-count complaint that defendant CSX Transportation, Inc. (“CSX”) violated the Employee Retirement Income Security Act of 1974, 29 U.S.C. § 1001 et seq. (“ERISA”), with respect to her late husband, H. Freeman Smith. CSX denied the plaintiff’s claim for voluntary severance pay benefits as Mr. Smith’s beneficiary.
