GALSTON, District Judge.
The matter comes before the court on exceptions filed by both sides to the report of the special commissioner.
By stipulation of libellant and cross-libellant an interlocutory decree was entered which provided that the balance due the Todd Erie Basin Dry Docks, Inc.
