ARNOLD, Circuit Judge.

William O’Blasney, a South Dakota state prisoner, brought this petition for habeas corpus, claiming that the respondent warden is confining him in violation of the Constitution of the United States. O’Blasney has been sentenced to 49 years and ten months in the penitentiary for the first-degree manslaughter of his infant child. The Supreme Court of South Dakota has affirmed his conviction on direct appeal. State v. O’Blasney, 297 N.W.2d 797 (S.D.1980).
