The significant and farreaching issue which is raised in this proceeding is whether the petitioner landlord is entitled to a judgment of possession of a rent-controlled accommodation pursuant to the 1983 Omnibus Housing Act (L 1983, ch 403) because the “named tenant of record” must maintain the said apartment as her primary residence.
