The defendant, Andrew Elam, was convicted in the circuit court of Cook County of the offense of armed robbery after trial by the court, and was sentenced to not less than 5 nor more than 15 years in the State Penitentiary.

About 11:00 P.M. on December 27, 1968, James McGarrity, a bus driver employed by the Chicago Transit Authority, was traveling east on 59th Street in Chicago when he stopped at Racine Avenue, where a man and woman boarded his bus.
