The defendant was charged with the murder of Ollie Westbrook. He was tried twice. On the first trial he was found guilty of manslaughter, but filed a motion for a new trial, which the judge below maintained. On the second trial he was tried for manslaughter, having been acquitted of murder on the first, and was found guilty. On the second conviction, after a motion for a new'trial had been overruled, he was sentenced to pay a fine of $1 and to suffer imprisonment at hard labor for not less than 9 nor more than 12 years.
