KNOX, District Judge.
Plaintiff, a seaman, asks damages of $50,-000 from defendant as a result of an injury sustained while serving as boatswain aboard the steamship Charles A. McAllister as she lay at or near a dock in Bone, Africa. He also asks to be awarded the sum of $10,000 for his maintenance and cure. Upon stipulation, the case was tried to the court in the absence of a jury.
