MEMORANDUM OPINION AND ORDER
PICKERING, District Judge.
Before the Court is Defendant’s Motion to Dismiss and in the alternative for Summary Judgment. Having considered these motions, the responses, the briefs of coun sel, the cited authorities and applicable law, the Court finds as follows:
FACTUAL BACKGROUND
This cause of action arises out of the alleged overcharging by Defendant of personal property insurance premiums on collateral for a $763 loan. Plaintiff also asserts class allegations. This Court has jurisdiction over this matter pursuant to 28 U.S.C. § 1332. The facts are recounted in a…
