— The indictment is founded upon the •statute (JPamph. Acts, 1880-81, p. 387), rendering it unlawful, •except upon the prescription of a practising physician, “to sell, give away, or otherwise dispose of spirituous, vinous or malt liquors,” within a designated locality in the county of Conecuh.
