This action was instituted by plaintiff to recover damages from defendant district for destruction of his growing crop because of its alleged obstruction of diffused surface waters by a spoil bank on its right-of-way for an irrigation canal. At the conclusion of plaintiff’s evidence the trial court sustained defendant’s motion to- dismiss and entered judgment for defendant. Upon the overruling of plaintiff’s motion for new trial, he appealed to this court, assigning as error that the order and judgment is contrary to the evidence and applicable law.
