COFFIN, Circuit Judge.
This is an appeal by the Commonwealth of Massachusetts from an order of the district court granting petitioner’s request for a writ of habeas corpus based on the denial of his right to a speedy trial. The appeal also embraces issues concerning the possible waiver of that right and the exhaustion of state remedies necessary before federal ha-beas corpus may be sought. Because of the exhaustion issue, we shall separate the facts and legal issues as they were presented in the state and federal proceedings.
