Introduction

*572This opinion is an expanded version of this court’s June 20, 2006 oral ruling and short form decision and order granting defendant’s pretrial in limine application to call an expert witness at trial on the issue of eyewitness identifications. My ruling was, of course, heavily influenced by the two most recent Court of Appeals decisions on this issue (see People v Drake, 7 NY3d 28 [2006]; People v Young, 7 NY3d 40 [2006]), and was based upon the Frye hearing (see Frye v United States, 293 F 1013 [DC Cir 1923]) I ordered and conducted.
