This suit was brought by Charles N. Cole to set aside the will of his father, John N. Cole, on the ground of mental incapacity. The testator died August 24, 1918, at the age of seventy-six years. He had lived on his farm near Fort Scott for many years and was well known in the neighborhood and had many acquaintances in town. His wife died in July, 1916, and in February of the following year he had a stroke of paralysis, rendering useless his left leg and arm, and affecting one side of his face.
