Whistenant brought suit against the Southern States Portland Cement Company, to recover damages for personal injuries. The defendant demurred to the petition, and it was dismissed. The only question, therefore, presented for our consideration is whether the allegations of the petition were sufficient to withstand the general and the special demurrers. The defendant operated'a railroad for private use; and it is insisted that rules different from those governing the liability of public-service corporations operating railroads should control.
