Ritz, Judge:
To review a judgment of the circuit court of Wyoming county rendered upon the verdict of a jury in an action for malicious prosecution, this writ of error is prosecuted.
The defendant David M. Klein was engaged in the mercantile business in the town of Mullens, in Wyoming county, occupying *294during the early part of the year 1918 for that purpose a storeroom owned by the Mullens Eealty Company.
