The plaintiffs in error, Gilbert and Roberts, as sureties for one George H. Layng, executed a bond to the defendant in error, conditioned for the faithful performance by Layng of his duties as agent, at the city of Atchison, for the defendant in error. The State Insurance Company incorporated under the laws of the state of Iowa, and was organized to do business as a fire-insurance company.
