State v. Troya
Missouri Court of Appeals
1Opinion of the Court
LISA WHITE HARDWICK, Judge.
Frank Troya appeals from his conviction for driving while intoxicated and ten-year prison sentence. Troya contends the circuit court erred in denying his motion to suppress his statement to police on the basis that it was obtained in violation of *697Miranda.1 He also contends the court plainly erred in sentencing because the ten-year prison sentence was based on a misunderstanding of the range of punishment. For reasons explained herein, we affirm Troya’s conviction but reverse the sentence and remand the cause for resen-tencing.
