In the complaint of the appellee against the appellants it was alleged that from December 1, 1895, nnt.il December 1, 1900, John J. Conrad, Conrad Strausborger, and Thomas M. Brown were the legally elected, qualified, and acting commissioners of Eranklin county, and as such constituted the board of commissioners of that county; that during that period these commissioners, acting as such board, by mistake and through inadvertence, allowed and permitted to be paid from the public funds of that county certain claims in favor ‘ of themselves and others which were not legal claims against the…
