In an indictment returned by the grand jury to the criminal court of Cook county it was charged in Count I that George Henneman on September 17, 1942 and prior thereto conspired with divers persons whose names were unknown, with malicious intent to unlawfully, wrongfully, wilfully, and mischievously injure the property of James Cappany, the same being a restaurant known as the ‘Glass Cupboard,” situated at 232 W.
