Plaintiff in error was convicted, by the judgment of the court below, of the crime of larceny. It was not seriously contested that a larceny was committed, or that plaintiff in error was connected therewith,—the property stolen being found in his possession. The defence was, at the time of the taking, and for some hours afterwards, plaintiff in error was under the’influence of intoxication caused by the fraud or contrivance of another person-for the purpose of'inducing him to commit, or to aid in committing, the larceny.
