In this action, the appellee, a citizen and taxpayer of the city of Prestonsbnrg, which is a city of the fifth class, sought to have it adjudged that the appellant, Jake Spurlock, was ineligible to hold the office of city marshal of the city of Prestonsbnrg, to which he had been appointed by the proper body of that city, and further that he and the deputy appointed by him, the appellant James Sizemore, be adjudged to be usurpers in their respective offices; that they be enjoined and…
