— Appeal from a judgment of the Supreme Court at Special Term (Ellison, J.), entered July 8, 1982 in Chemung County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination of the City Manager of the City of Elmira denying petitioner’s claim for death benefits pursuant to the terms of a collective bargaining agreement.
