James Cleek ("Cleek") and Molly Cleek filed a complaint in Marion Superior Court against the Metropolitan Emergency Communications Agency ("MECA") and its employee, Eric Wright ("Wright"), alleging that Wright's negligent conduct caused in*566Juries to Cleek. MECA and Wright moved to dismiss the complaint for lack of subject matter jurisdiction pursuant to the exclusivity provision of the Worker's Compensation Act.
