FINDINGS OF FACT AND CONCLUSIONS OF LAW
BATES, District Judge.
This is a civil action for breach of fiduciary duty brought under § 502(a) of the Employment Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1132(a). During the course of the litigation, the claims against all but one of the named defendants have been dismissed voluntarily or by order of the Court, and judgment on most claims against the remaining defendant has been entered against plaintiff.
