Special Judge. Appellee objects to the consideration of the assignments of error on the ground that no exception was filed by appellant in the trial court to the conclusions of fact filed by the trial judge. A statement of facts is brought up, and the assignments objected to attack the correctness of the conclusions of the trial Judge by reference to the statement of facts. Appellant filed a motion for a new trial, upon the overruling of which an exception was taken and notice of appeal given. This has been held sufficient without the entry also of a formal exception to the findings of fact.…
