This case represents another example of a workplace that has not yet been cleansed of racist attitudes. Defendants’ motion for summary judgment poses the difficult and recurring question of when these attitudes sufficiently alter the terms and conditions of a person’s employment such that the aggrieved employee has a cause of action under the federal civil rights laws.
