BRIGHT, Circuit Judge.

Augustin Jones, a physician practicing in St. Louis, Missouri, appeals a conviction for intentionally distributing Quaalude, a Schedule II controlled substance, 1 in violation of 21 U.S.C. § 841(a)(1) (1970). 2 Dr. Jones was charged with two counts of prescribing Quaalude without a legitimate medical purpose and outside the usual course of professional practice: count I related to a prescription written by Dr. Jones on January 10,1977, and count II related to a second prescription written on February 9, 1977.
