FRICKE, J., pro tem.

Defendants were convicted under two counts in an information charging robbery, one count charging an attempt to commit robbery, two counts of kidnaping for the purpose of robbery and eight counts of forcible rape.

The evidence under count one showed that on the evening of December 10, 1934, J. N. Carter, while walking on Euclid Avenue in Los Angeles, was attacked by three Mexicans, who struck him over the head with some object, knocking him down, took his hat, address book, glasses and about two dollars and then struck him some more.
