MEMORANDUM OPINION AND ORDER

Before the court is Defendant International Paper Company’s (“IP”) motion for summary judgment (Doc. # 39), which has *1229been fully briefed (Docs. # 40, 41, 42, 43, 44, 45, 46 (Brief and Evidence); 49, 50 (Opposition Brief and Evidence); 51 (Reply)).1 After considering the parties’ arguments, the evidence, and the relevant law, the court finds that Defendant’s motion is due to be granted.
