The plaintiff in error commenced an action in the District Court of Harper County, against the defendants • in error, to foreclose a mortgage on certain real estate in Harper County, executed by the defendant in error to the Lombard Investment Company to secure a note for fifteen hundred dollars, which note and mortgage were, before maturity, for value, indorsed and assigned to plaintiff in error.
