In an action to recover damages for legal malpractice, the defendant J. Steven Long appeals from so much of an order of the Supreme Court, Richmond County (Mastro, J.), dated July 11, 1997, as denied his motion, inter alia, to amend his answer to include the affirmative defense of the plaintiff’s lack of capacity to sue.
Ordered that the order is affirmed insofar as appealed from, with costs.
