Presently before the court are two motions for summary judgment — one filed jointly by plaintiffs First State Bank and Trust Company of Valdosta, Georgia (First Bank) and Fidelity & Deposit Company of Maryland (Fidelity); and a second one filed by defendant Bruce Mclver. Each motion asserts that there are no triable issues of fact and that judgment should be entered in their favor.
