This action was brought under the federal employers’ liability act and involves the question of the negligence of the defendant in not furnishing the plaintiff a reasonably safe place *187to work and the question of the plaintiff’s assuming the risk. Judgment was rendered for plaintiff and the defendant railroad company appealed, insisting first that the overruling of its demurrer to plaintiff’s evidence was error.
