Chem-Air South, Inc., as plaintiff below, sued Melvin Cross and Nichols-Cross, Inc., defendants below, for an injunction and damages. Plaintiff alleged defendant Cross (now also Nichols-Cross, Inc., and hereafter referred to in the singular) “commenced operation of a business ... in direct competition with Plaintiff’s business ...
