Appeal on questions of law from the Court of Common Pleas of Hamilton County.

Suit was filed by appellee against the appellant in the Common Pleas Court of Cuyahoga County to recover upon a contractor’s statutory bond for materials furnished in the construction of a power house for the State Hospital for the Insane in Hamilton County, Ohio. Motion to quash service of summons was made and sustained and the petition dismissed.
