In an action, inter alia, to recover a down payment for the purchase of real property, the plaintiff appeals from an order of the Supreme Court, Suffolk County (Tanenbaum, J.), entered October 15, 1986, which denied its motion for summary judgment, granted the cross motion of the defendants for summary judgment dismissing the complaint and in their favor on their counterclaim, *723and ordered an inquest on the issue of damages with respect to the counterclaim.
Ordered that the order is affirmed, with costs.
