¶ 1. Scott Partenfelder,1 along with Elm Grove Police Officer John Krahn and Officer Krahn's wife, Cyndi Krahn, appeal from the circuit court's order granting partial summary judgment to Soo Line Railroad Company and Steve Rohde, a Railroad employee.2 Partenfelder and Officer Krahn were *389both severely injured when a train hit the Partenfelders' van during the Elm Grove Memorial Day parade.
