ZAVATT, District Judge.

In this case, the defendant is charged under two separate indictments (one of six counts and one of one count) of having taken six letters before they had been delivered to the respective addressees. Two counts (Counts Three and Six) were dismissed during the trial on the motion of the defendant with no objection by the Government.
