This matter comes before the Court on cross-motions of Plaintiff Charles Cathcart (“Plaintiff’) for Motion to Dismiss or Alternatively, For a Stay (“Plaintiffs Motion”), on the motion of Defendant General Holding, Inc. (“General Holding”), for dismissal with prejudice (“General Holding’s Motion”), and on motion of Kevin Campbell, chapter 7 trustee (“Trustee”), for summary judgment as to Plaintiffs Fourth and Fifth Causes of Action (“Trustee’s Motion”).1 The Court has jurisdiction over this matter pursuant to 28 U.S.C. § 1334.
