The record in this case is extraordinary. Having carefully examined it, we are fully prepared to sympathize with the presiding judge of the trial court, who, while the trial was dragging its slow length along, remarked to the attorneys of the parties, “ If you keep on, I will be as crazy as the rest of you; I will begin to see visions.” In view of the record and the manner in which the case is presented for the defendant, we will, in accordance with the rule that whatever is not argued must be deemed waived (Gordon v.
