Affirming.

This action, was instituted, under the provisions of the “Declaratory Judgment Act,” section 639a — 1 et seq., Civil Code of Practice, in the Bell circuit court, and tried by agreement by Special Judge Cleon K. Calvert. Tbe purpose of tbe action was to obtain a declaration of tbe legal status of Elsie Eleanor Powers, tbe only daughter of Caleb Powers, deceased, and Dorothy Powers, his widow, under the will of Caleb Powers and to declare their rights or interest in a small parcel of land of about 1.48 acres situated in Bell county, Ky.
