In an action, inter alia, to recover damages for breach of contract, the defendants appeal from an order of the Supreme Court, Queens County (LeVine, J.), dated December 1, 2004, which denied their motion pursuant to CELR 5015 (a) (1) to vacate their default in appearing for trial, and to restore the action to the trial calendar.
Ordered that the appeal by the defendant Amwest Surety Insurance Company is dismissed as abandoned (see 22 NYCRR 670.8 [c], [e]); and it is further,
Ordered that the order is affirmed insofar as appealed from by the defendant Tulger Contracting Corp.; and it is further,
