Appellee brought this action against appellant to recover a certain sum of money alleged to be due on account of certain gas wells drilled on his land.

Tbe complaint was in three paragraphs, and a demurrer to each paragraph was overruled. Answer, in denial. Trial *5by the court. A special finding oí facts was made and conclusions of law stated thereon, followed by a judgment in favor of appellee for $1,000. It is- first insisted that neither paragraph of the complaint stated facts sufficient to withstand a demurrer.
