INTRODUCTION

Plaintiff, Insituform Technologies, Inc., brings this negligence action arising out of the failure of a sewer pipe lining designed by defendant, Jacobs Civil, Inc. Jacobs moves for summary judgment on Insituform’s claims, arguing that the action is barred by the applicable statute of limitations. In addition, Jacobs contends that the negligence claim is barred by the economic loss rule and that the evidence in the record is insufficient to support Insituform’s negligent misrepresentation claim.
